GENERAL TERMS AND CONDITIONS OF SUPPLY

 

Warranties               :        5 years on solar tank and panels. 1 year on solar accessories,  applies to domestic installations only.

All spare parts (where specified) are subject to 1 year warranty.

Possible Extensions available if previewed by the manufacturer.

Solar accessories are: Thermostatic Mixer, Expansion Vessel, T/P Relief Valve, Air Vent, Solar Controller, Differential Regulator.

No Warranty is given on electrical and plumbing components/parts.

Warranties are valid only upon subscription of a maintenance contract with Climacento and as long as the one in place applies.

 

Warranties starts from the date of purchase, yet they will become valid only after the account is fully settled and no outstanding balance is due. While an account is due, warranties will be considered null and invalid. Warranties are valid only if the installation and operating instructions, applicable to the model purchased, are expressly and completely followed. These instructions are supplied with the unit, and can be also available by writing to Climacento Green Tech email: info@climacento.co.ke.

 

The liability of Climacento Green Tech shall not exceed the repair or the replacement of the defective parts, under the limited warranty period, and shall not include transportation to or from the factory/warehouse, consequential, or incidental damages, or labor required for replacement and transport to the client site.

Loss of warranty          :      Unpaid balances, misuse of the appliances and lack of       subscribing/performing the Programmed Preventive      Maintenance as prescribed by the manufacturer.

Inappropriate use, misuse or unprofessional tampering. 

Climacento will not be held responsible for non-professional interventions and relative consequences caused by workers and third parties not employed or hired by Climacento directly. Failure to complying with the manufacturers maintenance instruction will also automatically imply the loss of warranty.

Use of inappropriate water in the system, contrary to our recommendations, also implies an immediate loss of warranty. Climacento holds no responsibility for damages to tanks and other parts due to “dirty” water which produce scaling or rusting phenomenon in the tanks, fittings and piping of the solar water heaters.

Use of the systems without the recommended accessories (safety valves, expansion vessels, appropriate piping, etc.)

Solar controller and the electric elements are covered by warranty only if protected by an original Sollateck AVS of appropriate sizing.

Offer Validity                 :        7 days subject to prior sales.

Invoicing                         :        80 % at order and 15 % at completion of the roof mounting. 5% after commissioning of the system. Please note that if the site is delayed for more than a month, 95% payment will still be demanded, regardless of the progression of the work and regardless of what has been supplied or not supplied and/or progression of installation work. Climacento does not bear responsibility for delays on payment if the commissioning cannot be done because of lack of water or electricity or any other delay in the site that is not under its direct control.

Delivery                         :           To be agreed and established.

At present, general delivery terms do not apply and have to be confirmed at the time of order.

General conditions normally applicable: i.e. components: from 3 to 5 weeks from order depending on stock availability, plus shipping time. For air shipment: 2 Weeks plus approximately 10 days for shipping and clearing.

Payments                       :           at Invoice issue.

Delay in Payment         :           the delays in payment attract a penalty interest of

2%. Climacento reserves the right of suspending all services in case of breach of contract/agreement.

Pre-orders                     :           30% at order and 50% before goods delivery.

Order needs to be completed within 6 months from goods availability.

If the site is not ready we will still expect the 50% payment to take us to 80% of the total invoice value at the end of the six month period.

Cancellations:                    Order cancellation attracts a 20% penalty fee and can be done within the first 30 days from order.

If goods are delayed on the ETA communicated to client for more than 60 days, then a full refund with no penalty can be issued.

 

Property                         :        All goods remain a property of Climacento up to full          payment reception.

 

Post-Sales Support    :        For any assistance whether under warranty or not, Climacento will charge an ON CALL service fee of 5000 Khs plus VAT (within Nairobi only). This is an Exit Feepayable in advance for the technicians to visit your premises within 24 hours from the time of the call with the exclusion of situations of force majeure and assess the problem. We recommend payments:

All three modes of payment will allow us to release the team immediately. Alternatively, please note that for transfers and cheques payment we require the amount to have cleared in our accounts before we can assist you.

Please note clients with outstanding balance with us will be requested to clear those first, before we can assist.

 

The technician in charge will proceed by identifying the cause of the problems experienced and, based on his specialization and on the availability of spare parts and/or other materials required,  he will rectify the situation if possible and if it makes economic sense.

 

If you wish to be provided with a quotation before the technicians proceed with the repair work, please inform the office in writing at operations@climacento.co.ke. If we do not receive any instructions from you, we will acknowledge automatically your intention for us to proceed with the repair.  In case you require a quotation upfront, the job will be performed only after you have accepted the charges. Of course that might imply rescheduling the work for another time since we cannot keep teams idle while the exchange of information and the authorisation process is ongoing.

In both cases (we either proceed directly or after a quotation) troubleshooting and repairs will be billed at:

Transport: Ksh 100 +VAT per KM.

Labour: Khs 1,500 +VAT per hour

Materials: as used and accordingly as per Climacento Green Tech Ltd price list at the moment of the call. The fee for the above mentioned call does not include any material necessary for repairs/replacements. Any materials and/or parts will be billed separately.

Materials that are covered by warranty will be replaced/repaired at no extra cost since we are extending you the manufacturer’s warranty, but labour and transport will still be applicable.

We offer our clients a 24/7 – 365 days/year service, but please note that Sundays and public holidays will attract a 100% extra charge on labour that will be charged double (3000 Khs + VAT / hour).

At accomplishment of any intervention, our Technicians will request the client to sign a copy of the Worksheet where all operations performed will be listed and clearly described. Copy of the same will be issued to the client as well.

For billing purposes the below procedures will be in place.

After every repair done upon your call, our Technicians will require the Client to sign a Trouble Ticket where there will be listed:

a)                  the exact number of hours required to perform the                    repair,

b)                  the time spent travelling to the Client premises and           back,

c) the hours, if any, spent in sourcing the urgently required materials

d)                  the materials, devices, appliances utilized and/or                       substituted

e)                  any other extra expense incurred in order to perform                  and accomplish the repair

One copy of the Trouble Ticket/Worksheet will be left with you (or a client representative in case of the client absence) who will be requested to sign for acknowledgement and acceptance. Please note that someone needs to be available and instructed accordingly for signature purposes otherwise if nobody is present our staff is not authorised to conduct any intervention. If you are personally not available, kindly make sure someone is aware of this procedure to avoid personnel refusing to sign.

The invoice for the same will be issued within the current month and after payment for the work performed is fully received.

The Technicians who perform the Repair as well as the Extraordinary Maintenance Interventions work in couple. The solution is adopted for safety reasons since the work involves ladder use, roof climbing, intervention on electrical motors and other electrical appliances.

Working hours              :        Climacento working hours are:

Mondays to Fridays: 8:00 am to 5 pm.

Saturdays: 8:00 am to 1pm.

Excluded all public holidays and other national festivities.

If any work is carried out outside the above mentioned WORKING HOURS it will be billed with 100% surcharge. 

Outside Nairobi             :      Additional cost of transport and accommodation to the client site outside of Nairobi will be negotiated with the client at the time of signing this contract.

As reference fee, the travel allowance for a technician per day starts from a minimum of 5,000 KSh+VAT plus the cost of transport, unless you can provide adequate accommodation and three meals a day.

If the transport is provided by Climacento vehicles the cost is Ksh.100 +VAT per KM.

The fee for the call outside the preventive maintenance will be billed at 1,500 Ksh +VAT per hour, plus transport, labour, materials as previously described.

Insurance                       :        In order to give further guarantees to his clients Climacento holds insurances to cover the possible damages occurring to goods or persons during work.

Costs of removal of building materials and disposal of the same. All masonry works (break through for solar piping, etc., basements for solar boiler positioning, reinforcing of the roof slab, etc.) Lifting/moving of the solar collectors and boiler (equipment, permits and labour). Electric installations not expressively mentioned.
